    • Chula Vista Reduction of Debt

      The bankruptcy law is intended to keep higher income earners out of Chapter 7 cases, based upon the median income. One of our clients was earning approximately $243,000.00 per year and the median income for his size of family was $79,971.00. We fought this case for over nine (9) months arguing special circumstances applicable to his family, and the United States Trustee’s Office finally came around to our argument and our client was allowed to proceed with a Chapter 7 case and get rid of over $300,000.00 of debt.

    • Reduction of Taxes

      One of our specialties is the reduction or elimination of taxes in bankruptcy. Our clients came into our office with over $110,000.00 of past due taxes. We filed a Chapter 13 case, completely eliminating $87,000.00 in taxes. The clients paid $350.00 per month over five (5) years for the remaining taxes.

    • CA Past Due Accounts

      Our clients came into our office past due on their first and second mortgages, past due on their cars, and over $50,000 of credit card debt. We filed a Chapter 13 case which allowed them to repay their past due amount on their first mortgage. We completely eliminated their credit card debt and eliminated (lien stripped) their second mortgage.

      Most cases there is no liquidation of assets. However in about 5% there is a potential of liquidation. We were able to protect the clients home with $165,000.00 of equity and the only issue was the Client’s tax refunds which the trustee told us to turn over. Our clients were thrilled when I returned their IRS and State Tax Checks of approximately $2,000, after we convinced the trustee that this would be a waste of time for him to pay creditors with. Once again, no lost assets.
